1. Introduction

GinaAndVik.com (“the Platform”, “we”, “our”, “us”) is an online marketplace that connects Buyers with independent Vendors who sell all types of uniforms, including school uniforms, corporate uniforms, medical scrubs, security uniforms, hospitality wear, industrial workwear, sports uniforms, and custom branded apparel.

By accessing or using the Platform, you agree to these Terms & Conditions (“Terms”). If you do not agree, you may not use the Platform.

2. Definitions

• “Platform” refers to GinaAndVik.com and all related services.

• “Vendor” refers to any individual or business listing uniforms for sale.

• “Buyer” refers to any individual or business purchasing uniforms through the Platform.

• “User” refers to any person accessing or using the Platform.

• “Products” refers to all uniform categories listed by Vendors.

• “Order” refers to a purchase made by a Buyer.

3. Marketplace Role & Disclaimer

GinaAndVik.com is a marketplace, not the seller. We do not:

• Manufacture or own the products listed

• Guarantee product quality, sizing, availability, or delivery timelines

• Control Vendor behaviour or stock accuracy

All sales are agreements between Buyers and Vendors. We facilitate the transaction but are not a party to the sale.

4. Eligibility

To use the Platform:

• Buyers must be 18 years or older.

• Vendors must be legally permitted to trade in South Africa.

• Users must provide accurate information.

We may suspend or terminate accounts that violate these Terms.

5. Vendor Requirements

Vendors agree to:

• Provide accurate product descriptions, pricing, and stock levels.

• Supply authentic and compliant uniforms across all categories.

• Fulfil orders within stated timelines.

• Respond to Buyer queries promptly.

• Comply with South African consumer protection laws.

• Honour return and refund policies.

• Maintain professional conduct.

We may verify Vendor identity, remove listings, or suspend Vendor accounts.

6. Buyer Responsibilities

Buyers agree to:

• Provide accurate delivery information.

• Review product details before purchasing.

• Communicate respectfully with Vendors.

• Follow the Platform’s dispute process.

7. Product Listings

All product listings must be accurate, truthful, and include:

• Clear photos

• Correct pricing

• Relevant uniform category (school, corporate, medical, etc.)

• Any required specifications (sizes, colours, branding, compliance standards)

Misleading listings may result in suspension.

8. Orders & Payments

8.1 Payment Processing

Payments are processed through third‑party payment gateways. Buyers agree to the payment gateway’s terms.

8.2 Vendor Payouts

Vendor payouts occur according to the payout schedule published on the Platform.

8.3 Failed Payments

We are not responsible for payment gateway errors, bank delays, or failed transactions.

9. Commission & Fees

GinaAndVik.com charges Vendors:

• A commission per sale.

• Optional subscription fees (if applicable).

• Optional listing boost fees.

Fees may be updated with notice.

10. Delivery & Logistics

Delivery options are provided by Vendors or third‑party couriers. We are not responsible for:

• Lost parcels

• Delayed deliveries

• Incorrect delivery addresses

• Courier errors

Buyers must contact Vendors for delivery issues.

11. Returns & Refunds

Returns and refunds are governed by:

• The Vendor’s return policy

• The Consumer Protection Act (CPA)

• Marketplace rules published on the Platform

Buyers must submit return requests directly to Vendors. We may assist with disputes but do not guarantee outcomes.

12. Disputes

12.1 Buyer vs Vendor

Disputes must be submitted through the Platform’s dispute process.

12.2 Vendor vs Platform

Vendors may contact support for resolution.

We may mediate disputes, request evidence, issue warnings, or suspend accounts. Our decision is final.

13. Prohibited Conduct

Users may not:

• List counterfeit or unauthorised uniforms

• Misrepresent uniform category or compliance (e.g., medical, security, industrial)

• Misuse corporate or school branding

• Harass or abuse other users

• Upload harmful or illegal content

• Attempt to bypass Platform fees

• Engage in fraudulent activity

14. Intellectual Property

All Platform content (logos, branding, design, text) is owned by GinaAndVik.com and may not be copied or reproduced without permission.

Vendors retain ownership of their product images and descriptions but grant us a licence to display them.

15. POPIA & Privacy

We comply with the Protection of Personal Information Act (POPIA). We collect and process personal information to facilitate orders, verify accounts, and improve Platform functionality. Users may request data deletion or correction. Full details are provided in our Privacy Policy.

16. Limitation of Liability

GinaAndVik.com is not liable for:

• Product defects

• Incorrect sizing

• Delivery delays

• Vendor misconduct

• Buyer misuse

• Losses arising from use of the Platform

Users agree to use the Platform at their own risk.

17. Indemnity

Users agree to indemnify GinaAndVik.com against claims, damages, losses, and legal fees arising from misuse of the Platform or violation of these Terms.

18. Account Suspension & Termination

We may suspend or terminate accounts for:

• Fraud

• Misconduct

• Violation of Terms

• Harmful behaviour

• Non‑compliance with policies

19. Changes to Terms

We may update these Terms at any time. Continued use of the Platform constitutes acceptance of updated Terms.

20. Governing Law

These Terms are governed by the laws of South Africa.
